Motor Claim

In general, there are five categories of motor claims:

  • Own Damage (OD)
  • Theft
  • Windscreen
  • Third Party Property Damage (TPPD)
  • Third Party Bodily Injury (TPBI)

If the policyholder intends to make a claim, the policyholder has to make a report with the police within 24 hours of the accident and notify Liberty Insurance Berhad within 7 days.

Workshop will download the claim form from Merimen or uniclaims and insured needs to complete and sign accordingly, and submit together with copy of the following documents to workshop.

  1. Original police report
  2. Copies of:
  • Insurance policy / cover note
  • Vehicle registration card
  • Identity card and driving license of the vehicle owner
  • Identity card and driving license of the driver
  • Hire purchase agreement (if applicable)

OD- KfK claim is similar to an Own Damage claim with exception that NCD will not be forfeited on renewal of the policy. Introduced by Persatuan Insurans Am Malaysia (PIAM) effective June 2001 in order to expedite the claim process, this claim is applicable only when the accident is deemed not insured fault. This is determined by the circumstances of the accident and through the police investigation report (ie Police compound/findings, sketch plan and key) to support the claim.

Follow the procedure as outlined in "Own Damage Claim". In addition to the documents to be submitted with claim form, please enclose the following documents. 

Copies of:

  • Signed declaration letter (for OD-KfK accident)
  • Third party's police report
  • Police compound / findings
  • Police sketch plan and keys (if any)
  • JPJ search

The policyholder should be reminded not to enter into any claim negotiations with the other party without the consent of the insurer. The policyholder must also be reminded not to admit liability in any circumstances as it may prejudice the right of the insurer in terms of settlement with the other party.

 

If the vehicle is stolen, and the policyholder has comprehensive cover, the policyholder can make a claim by completing a Motor Loss Form at the nearest Liberty Insurance Berhad within 3 days from the loss.

The following documents have to be submitted:

  • Police report
  • Copy of policyholder's insurance policy or cover note
  • Vehicle registration document ("log book")
  • Identity card of policyholder and driver
  • Driving licence of driver
  • Hire purchase agreement, if applicable
  • All keys for the lost vehicle

The branch will register the claim and conduct an in-house interview using the appropriate interview forms or appoint an independent adjuster to investigate the theft where there are any areas of dispute. The policyholder will be notified of the appointed adjuster.

The policyholder will personally have to get a report from the Police on the results of their own investigation of the theft. [No Further Action]

A claim for theft will be approved after 3 months from the date of the claim, provided a No Further Action (NFA) report is received from the Police. The policyholder will have to personally obtain the report from the Police. If a report is not available from the Police, the theft claim will be settled within 180 days, as provided in the Guidelines by Bank Negara Malaysia.

A discharge letter will be sent to the policyholder. It has to be signed by the policyholder and the Finance Company. It has to be stamped with a RM10 stamp duty and returned to Liberty Insurance Berhad. Liberty Insurance Berhad will pay the claim within 7 days.

If there are loan repayments for the vehicle, the finance company will also have to endorse the discharge letter, and the payment will be made directly to the finance company.

Liberty Insurance Berhad has to be notified if the vehicle is recovered in order to inspect the vehicle for any damages. The appointed adjuster will have to inspect the vehicle before removal to Liberty Insurance Berhad´s Depot.

Once the repairs are completed, the car will be released to the policyholder once the policyholder signs a discharge letter.

 

The policyholder can make a claim if the vehicle has a comprehensive cover inclusive of the additional premium for the windscreen cover. The vehicle needs to be sent to the nearest Branch if drivable or the policyholder may take his vehicle to the nearest panel workshop to repair the damaged windscreen.

The policyholder will have to complete a Windscreen Report Form, which can be obtained from the nearest Liberty Insurance Berhad branch, and submit the following documents:

  • Photographs of damaged windscreen
  • Repair bill if windscreen is already repaired

If the documents submitted are complete and adequate, all windscreen claims will be subjected to vetting by the Technical Department and the actual cost to replace the windscreen will be approved and offered.

The approval letter will be prepared by the respective Regions and the offer will be sent out within 7 days from the receipt of the complete documentation.

The payment via cheque will be posted to the policyholder within 7 days from the receipt of the signed discharge voucher.

Even though you do not intend to make any claim or you are making a Third Party claim against the third party insurer, you are required to Notify Liberty Insurance Berhad for protection against liability resulting from the accident, against yourself and your Insurer.

You can collect the claim form from our branches, complete and sign accordingly, and submit together with copy of the require documents (attached with the Claim form) within 14 days.

 

A third party bodily injury claim is a claim made against the insurer of the negligent party for injuries incurred by the policyholder.

The following process is to be observed when making a claim against the third party insurer:

  • The policyholder will have to lodge a Police report within 24 hours of the accident and notify Liberty Insurance Berhad´s nearest branch within 7 days.
  • The policyholder will have to obtain a medical report and retain the medical bills of the treatment for submission to the third party insurer.
  • The policyholder will also have to notify the other party´s insurer in writing of his intention of making a claim. If the insurer is not known, the policyholder will have to obtain details of the insurer by making a search at JPJ.
  • The third party insurer will request documents to support the claim.
  • The third party insurer will process the claim and contact the policyholder to offer a settlement.
  • If there is a dispute on the settlement figure, the policyholder should seek clarification from the third party insurer or seek advice from a solicitor. The costs of engaging a solicitor will be borne by the policyholder personally.
